Synopsis:

The case was brought on behalf of a 42 year-old husband and father of three who died from a cerebellar stroke.

In asking the jury to award between $4.5 and $7 million dollars, the plaintiff argued that the firm’s client failed to thoroughly examine the patient after he presented to the emergency department and failed to order timely and appropriate diagnostic testing.

The defense successfully argued that the evaluation and management of the patient was appropriate and that this rare type of stroke has a high incidence of mortality.

After a three-week jury trial and five days of deliberations, a jury returned a verdict in favor of the defendant physician.
