Synopsis:

DBMS successfully defended a family practice physician in a case involving an alleged improper prescription of anti-inflammatory medication to a patient with chronic kidney disease.

The patient claimed the medication caused him to go into kidney failure requiring dialysis and kidney transplant. DBMS argued on behalf of the defense that the physician never authorized the prescription at issue. Even if he had, the prescription was within the standard of care and did not cause or contribute to the patient’s injuries.

Plaintiff asked for nearly $3 million for plaintiff patient plus an additional “substantial” amount for plaintiff wife’s loss of consortium damages. The jury returned a unanimous verdict for the defense after deliberating for less than an hour.
