The patient had chronic vascular disease and had suffered an above the knee amputation of his leg as well as a stroke which left him without the ability to speak or use his right arm. The plaintiffs, the patient and his wife, alleged that the defendant physician failed to properly monitor the vascular disease and the threatened status of the lower limb, allowing the circulatory compromise to eventually require the amputation of the leg and cause a cerebral vascular accident.
After nearly two weeks of trial before Judge Irwin Solganick, the jury rejected the plaintiff’s request for $4.75 million.
