Plaintiff’s decedent was strangled by the automatic shoulder belt following a rollover accident. Plaintiffs claimed that the automatic shoulder belt system was defective due to inadequate warnings and instructions regarding the use of the vehicle’s manual lap belt.
Plaintiffs also claimed that the automatic shoulder belt system is not effective in preventing life threatening and serious injuries without the use of a manual lap belt.
The decedent’s three surviving daughters claimed damages for the pecuniary loss of their mother and for the conscious pain and suffering she endured prior to her death.
Plaintiff sought $829,000. The jury returned a defense verdict.
