Plaintiff alleged that she suffered from severe dry eye syndrome and resulting visual distortions following the excision of a bulbar conjunctiva cyst.
Plaintiff claimed that the surgeon failed to obtain a proper informed consent and that the surgery caused the dry eye syndrome.
Defense successfully argued that the surgery did not cause her dry eye condition which was pre-existing and that dry eye syndrome was not a recognized risk of this particular procedure as performed.
Plaintiff sought over $700,000. The jury returned a defense verdict.
