Plaintiff alleged that the firm’s client, a vitreous and retina surgeon, had improperly performed a vitrectomy and retina repair procedure and that the surgeon had failed to timely diagnose and treat a purported post-operative endophthalmitis (infection of the eye).
The plaintiff asked the jury for over $1 million in damages.
The defense successfully argued that the eventual loss of the plaintiff’s eye was attributable to his long-term diabetes and resulting diabetic retinopathy and neovascular glaucoma.
