Overview

Mark M. Burden is a trial lawyer who concentrates his practice on the defense of physicians, hospitals, and allied healthcare practitioners in professional liability lawsuits. Mr. Burden has successfully resolved hundreds of medical negligence cases and has tried to verdict more than 30 cases. The vast majority of his trial practice has involved the defense of medical professionals. 

Mr. Burden has been an invited speaker at numerous bar association CLE presentations and healthcare seminars on such topics as risk management, bariatric surgery, managing a malpractice lawsuit, technology in the courtroom, preparing an opening statement in a jury trial, and effective cross-examination of expert witnesses.

Mr. Burden was named Managing Partner of Donohue Brown in 2017. He joined the firm upon its founding in 1995 and has been a partner since 2000. He initially started his practice at Baker & McKenzie in 1992.

He received his undergraduate degree from Cornell University in 1989 and his law degree from Chicago Kent College of Law in 1992, where he served as an editor of the Law Review. He also served as an extern with the United States Attorney’s Office for the Northern District of Illinois and for the Honorable James B. Zagel of the United States District Court for the Northern District of Illinois.

Mr. Burden is on the board of directors of the Society of Trial Lawyers and is a member of the American Board of Trial Advocates.

Experience

Mr. Burden has extensive trial experience, having tried to verdict dozens of cases on behalf of healthcare providers. A few recent highlights include:

  • Gulino v. Primary Care Physician – – Mr. Burden defended a primary care physician in a difficult high exposure case where the plaintiff obtained a verdict in excess of $12 million against co-defendants, but Mr. Burden’s client was found not guilty.
  • Avendt v. Primary Care Physician – – Mr. Burden obtained a defense verdict on behalf of a primary care physician in a failure to diagnose prostate cancer case involving allegations of failing to screen for prostate cancer while the patient was receiving testosterone supplementation.
  • Koleno v. Dermatologist – – Mr. Burden successfully defended at trial a dermatologist in a high exposure failure to diagnose cancer case. The case involved aggressive skin cancer which resulted in the passing of a 62-year-old married father of five children. The plaintiff’s attorney at trial asked the jury to return an award in excess of $8 million. The jury returned a defense verdict.
  • Wiencek v. Physician – – Mr. Burden successfully defended at trial an attending physician who admitted a 35-year-old mother of five complaining of migraine headaches to a hospital for a workup and pain management. After receiving several doses of Dilaudid and within several hours of the admission, the patient arrested and died. The plaintiff’s attorney asked for an award in excess of $5 million and the jury returned a defense verdict.
