Kent Mathewson and Mason Kienzle successfully defended an ophthalmologist in a jury trial who was alleged to have incorrectly dosed a medication for treatment of herpes zoster ophthalmicus. The patient suffered from end stage renal disease and was being treated with hemodialysis which complicated the dosing issue. The patient was hospitalized for a month followed by seven weeks at a nursing home for a central nervous system disorder. In prevailing at trial, the defense argued that the ophthalmologist acted reasonably, there was no evidence of a toxic dose of the medication, and that the prolonged hospitalization was actually caused by coincidental bacterial infections requiring several surgical procedures.
