DBMS attorneys Stetson Atwood and Ashley Dus successfully defended a psychologist and a medical group in a medical negligence trial in which plaintiff claimed he suffered emotional distress. Plaintiff alleged that, on October 17, 2017, the defendant psychologist deviated from the standard of care by failing to relay information regarding the patient’s psychological symptoms to his subsequent treating providers, resulting in the emergency department’s decision to transfer the patient to a behavioral health hospital where he was admitted by a psychiatrist for inpatient treatment.
After plaintiff rested his case, the defense moved for a directed verdict. The Court granted the motion for directed verdict and entered judgment in favor of the defendant psychologist and medical group, and against the plaintiff.
