Edward E. Fu and Mark H. Boyle obtained a defense verdict in a wrongful death asbestos product liability trial in Morgan County, Illinois. The Plaintiff alleged that the Defendant Manufacturer failed to provide adequate warnings to the decedent, who alleged exposure to the automaker’s asbestos containing automotive friction products while working at two dealerships beginning in the mid-1960’s. DBMS challenged the sufficiency of the exposures and the alleged diagnosis of asbestosis by his treating physicians and expert witnesses. DBMS also pointed to the Plaintiff’s smoking history and prior tuberculosis as the cause of his lung disorders and death. After a two-week trial, the jury returned a verdict in favor for the Defendant.
