DBMS Obtains Defense Verdict in Asbestos Trial

Synopsis:

Edward E. Fu successfully defended an auto manufacturer in a two-week asbestos product liability trial in McLean County, Illinois. The Plaintiff alleged that the Defendant failed to provide adequate warnings to their client, a career vehicle mechanic, who allegedly was exposed to the Defendant’s asbestos containing automotive friction products, including brakes, clutches and gaskets, while working as a mechanic at Defendant’s dealership and other garages beginning in the 1950’s.  DBMS presented evidence that the Plaintiff’s alleged exposures were not sufficient to cause any asbestos-related disease and challenged the Plaintiff’s diagnosis of asbestosis by his treating physicians. DBMS also pointed to the Plaintiff’s heavy smoking history and exposures to amphibole asbestos while working at UNARCO as the cause of his lung diseases.  After the plaintiff requested over $6 million in damages, the jury returned a verdict in favor for the Defendant.
