Synopsis:

Plaintiff alleged that the defendant doctor had improperly performed a surgical repair of an incisional ventral hernia. Plaintiff specifically alleged that the defendant doctor should have used a mesh patch to repair the incisional hernia rather than using a separation of parts procedure which required the excision of a flap in order to decrease the tension on the operative site.

The defense successfully argued that the separation of parts procedure was well within the standard of care on this patient and that no deviation from that standard caused the plaintiff’s post-surgical problems.

The jury returned a defense verdict in less than an hour.
