The plaintiff was admitted to the hospital in labor with her first child on December 4, 2001. She received her prenatal care from the firm's client and was diagnosed with gestational diabetes during the pregnancy.
During the delivery at issue, shoulder dystocia was encountered. Our client performed the proper maneuvers and used the appropriate amount of traction to accomplish delivery. The infant was diagnosed with a left brachial plexus injury after birth.
Plaintiff argued that the defendant used excessive force in delivering the infant. The jury returned a verdict of not guilty.
